Professional Negligence

Businesses and individuals frequently engage professionals for services and advice, relying upon their experience and expertise.

However, sometimes professionals can let you down and cause you to suffer loss. Where a professional has been negligent and you have suffered loss, you may be able to recover compensation from the professional or its insurers because of its failure to meet the standard of a reasonably competent professional in that particular field. We can advise you on the merits of bringing a claim against a variety of professionals including;-

  • Surveyors
  • Architects
  • Accountants
  • Solicitors

It is important to remember that a claim in professional negligence is separate from a complaint to the professional’s regulator. For example, whilst the SRA may be able to impose a fine as a sanction on a solicitor for poor service, it cannot award damages in the same way that the court can. Very often, the regulatory bodies are there to deal with conduct and client care issues. Issues over negligence and whether someone should be compensated, rests with the court.

It is also important to remember that whilst a professional may have been negligent, for a claim to be worthwhile pursuing through the courts, you must be able to prove that you have suffered financial loss because of the negligence.

We can advise you on whether it is appropriate to pursue a professional negligence claim and assess the likely value of it. We will explain the options available to resolve the dispute and the steps that should be taken before proceedings are issued at court. It is in the interests of all parties involved in a negligence claim to resolve the matter amicably and early on if at all possible, rather than becoming entrenched in potentially lengthy and costly litigation.
